3.在本合同有效代理期内,甲方不得与地区指定的其他代理人
    

第三条费用负担
    

项目的宣传费用(包括但不限于报纸和电视广告,印刷宣传资料、销售书籍、制作沙盘等)由甲方支付。成本发生前一次性支付
    

具体销售人员的费用和日常费用由乙方支付
    

第四条销售价格
    

销售底价(代理项目各楼层的平均价格)由甲、乙双方确定,每平方米人民币元,乙方有权根据市场销售情况,经甲方批准后灵活浮动。甲方提供并确认的销售价格表是本合同的附件
    

第五条代理佣金和付款
    

1.如果乙方的实际销售价格超过销售底价,则乙方的代理佣金为项目价格表中销售额的百分之十,甲、乙双方按五比五的比例分摊。代理佣金由甲方以人民币支付。
    

2.甲方同意按以下方式支付代理佣金:
    

在甲方签订正式的销售合同并获得首笔房款后,乙方完成销售合同中规定的房地产代理销售,乙方可获得本合同规定的全部代理佣金。甲方应在收到首期房款后3天内,向乙方支付所有代理佣金,乙方在收到甲方转来的代理佣金后,应开具收据
    

乙方应代表甲方收取房价,并在扣除应付给乙方的佣金后将余额退还给甲方
    

3.如果乙方代表甲方收取房价款,这是一次性付款,乙方应在本合同签订并收取房款后5日内将房款汇入甲方指定的银行账户;分期付款的,每两个月将收到的房款汇给甲方。乙方不得挪用未经授权收取的房款
    

4.因客户违反临时销售合同而没收的定金,由甲、乙双方按50%分摊
    

第六条甲方的责任
    

1.甲方应提供以下文件和资料:乙方材料:
    

(1)甲方新开发建设项目的营业执照副本和银行账户副本,甲方应向政府有关部门提供项目批准的开发建设、建设用地批准证书和许可证(包括:国有土地使用权证书、建设用地批准证书、规划许可证、,建设项目规划许可证、开工许可证)和本项目的商品房销售证、出口商品房预售许可证、出口商品房销售许可证;对于旧房地产,甲方应提供房屋所有权证和国有土地使用权证(3)代售项目所需的相关资料,包括:外形图、平面图、地理位置图、室内设备、建筑标准、电气设备、层高、,面积、规格、价格、其他费用估算等(4)乙方代理销售本项目所需的收据和销售合同以实际使用数量为准,(5)甲方正式委托乙方作为项目销售(独家)代理的授权委托书
    

甲方应在合同签订后2天内向乙方交付上述文件和资料
    

甲方保证:采购(2)(3)(3)(3)(3)(3))(3)(3)(3)(3)(3))(3)3 41,并确保乙方客户订购的房间号码不被误订
    

3.甲方应按照本合同规定按时向乙方支付相关费用
    

第7条乙方的责任
    

1.在合同期间,乙方应做好以下工作:
    

(1)制定促销计划(包括市场定位、销售目标、销售计划、广告、,(2)根据营销计划制定销售计划和时间表(3)在委托期内根据甲乙双方约定的条件进行广告宣传和策划(4)在甲方的协助下分发宣传品和销售书籍,安排客户实地考察,介绍项目、环境和条件
    

(6)以各种形式开展多渠道销售活动
    

(7)在甲方与客户正式签订销售合同之前,乙方代理签订临时房地产买卖合同并收取定金(8)乙方不得在甲方授权范围以外向客户作出任何承诺。2.在销售过程中,乙方应:,根据甲方提供的信息,本项目的特点和条件应如实向客户介绍,并尽可能不夸张地推广,隐瞒或过度承诺
    

3.乙方应遵守甲方规定的销售价格,未经甲方授权,不得向客户提供任何形式的折扣。当客户同意购买时,乙方应按照双方确定的付款方式向客户收款。如遇特殊情况(如客户一次购买多台机组),乙方应通知甲方进行个案协商
    

4.乙方收到客户付款后,不得挪作他用,不得以甲方名义从事除销售房地产以外的任何其他活动第八条合同的终止和变更,合同终止后,双方应充分配合妥善处理有关事宜,解决与合同有关的法律和经济问题。本合同终止后,双方的合同关系终止,甲乙双方不再相互承担任何经济和法律责任,除甲方未按本合同规定向乙方支付应付费用外
    

2.经双方同意,可签订变更或补充合同,其条款与本合同具有同等法律效力
    

第九条其他事项
